The Commonwealth Court of Pennsylvania issued an important decision on May 11, 2020, in which it determined that annual registration as well as publication of a registrant’s personal information on the internet constitutes punishment.
Can someone please tell me what the May17 2020 ruling means? Is this ruling in effect or has it been over turned? I’m on the registry for another few years do they still publish my info? It doesn’t say much just that publishing and annual registration is punitive
T.S. v. PSP is only a win for those whose offense date pre-dates Megan’s Law -1. You can do an applied challenge if your case is similar. If there is a stay, wait for the higher court to rule on T.S. v. PSP. If they uphold the decision of the lower appeals court, T.S. v. PSP case becomes a precedent case for an applied challenge.
